Cash Discount vs Credit Card Surcharge: What U.S. Restaurants Need to Know
Card processing fees can quietly eat 2–3% of every sale. Cash discount and surcharge programs both price cash and card payments differently — but they're not the same, and they're not equally legal.
We get this question every week from restaurant and café owners: "Is it legal to charge customers a fee for using a credit card?" The short answer is yes — but how you do it matters. This guide explains the difference between cash discount and surcharge programs, what's legal where, and which one PalomaPOS automates for you.

The two approaches, side-by-side
Cash Discount: You display the price assuming card payment. Cash payers receive a discount at the register. It is a discount for paying cash, not a fee for paying by card.
Surcharge: You display the price assuming cash payment. Card payers are charged an additional fee at the register.
The end result is similar — the cardholder pays slightly more than the cash customer. But the legal treatment is very different.
Legality across U.S. states (2026)
Cash Discount is legal in all 50 U.S. states under the Durbin Amendment (2010), as long as the cash price is clearly posted and the discount is offered at the time of sale.
Surcharging is more complicated. As of 2026, surcharging is allowed in most states but is restricted or capped (typically at 3% or 4%) in several. Connecticut and Massachusetts have historically restricted surcharging, and rules continue to evolve. Card brands also impose their own caps and disclosure rules.
This is general information, not legal advice. Confirm current rules with your state's department of consumer protection or a payments attorney before launching either program.
What customers actually feel
Cash Discount feels like a small reward for paying cash. Many customers don't notice it — and the few who do tend to be happy about it.
Surcharge feels like a punishment for paying with a card. It creates more pushback, especially from regulars on auto-pay. A cash discount frames the same price difference as a reward for paying cash, which most guests find easier to accept.
How PalomaPOS automates Cash Discount
PalomaPOS Cash Discount mode handles every step:
- Compliant menu pricing display at the register and on receipts
- Automatic discount calculation for cash payers
- Signage included, and we explain the card-brand and state rules that apply to you
- Cash and card prices shown clearly on screen and on receipts
- Refund handling that matches the original payment method
The result: a cash price and a card price your team doesn't have to calculate, and no awkward surcharge line on receipts. Check your effective rate on each statement to see the effect.
What does this mean in dollars?
For a quick estimate: a restaurant doing $40K/month in card sales at 2.6% + $0.10 pays roughly $1,240/month in processing fees — about $14,880/year. Use our effective rate calculator to see what you pay today.

FAQ
Is cash discount legal in every U.S. state?
Yes. Cash discount is permitted in all 50 states when implemented with proper signage and pricing display. The federal Durbin Amendment (2010) explicitly protects this practice.
Can I do surcharge instead?
Surcharging is allowed in most states but restricted in some. Card brands also impose their own caps (typically 3% or 4%) and disclosure rules. We recommend Cash Discount because it's universally legal and customer-friendly.
Will Cash Discount lose me customers?
It depends on your guests. Clear signage and a visible cash price help — guests see exactly what they pay and can choose cash for the lower price. Run it past your regulars first.
How does PalomaPOS handle the math?
PalomaPOS calculates the discount automatically at checkout and prints a compliant receipt. You don't have to do anything different — just choose Cash Discount mode in your settings.
